§ 1) Validity
The general terms and conditions apply to all business relations between CY Syndicate GmbH (CYS) and its customers. When placing an order, the customer confirms to have read and agreed with the general terms and conditions. The mere viewing of our website is not binding and does not establish a legal relationship.
§ 2) Offer
All prices are in the currency chosen by the customer including VAT, unless stated otherwise. The listed prices, product images and product descriptions are without guarantee. Delivery times, availability and other errors and omissions excepted.
§ 3) Delivery Times
Products that are on stock will be processed immediately after receipt of the order by CYS; other products will be ordered from suppliers. The ordered products will be delivered according to the agreement with the customer. Delays due to unavailability at suppliers or missing information from the customer does not result in any claims of the customer.
§ 4) Shipping
Shipping costs are calculated according to the weight of the package and shown accordingly in the order process.
It is the responsibility of the customer to clarify whether the goods can be imported into the country of destination. Any additional costs due to missing approvals or other deficits are to be borne by the buyer.
§ 5) Payment
Payment terms for goods ordered from CYS are 100% in advance unless stated otherwise.
In case of payment against invoice, the deadlines noted on the invoice apply. In the event of late payment, CYS may charge interest on arrears at the rate of 8.0% p.a. starting on the 7th day after the due date indicated on the invoice, and a reminder fee of CHF 25 per reminder sent.
§ 6) Warranty
CYS undertakes to take care and deliver products of good quality. The warranty period is one year, if not stated otherwise.
Excluded from the warranty are defects and malfunctions for which CYS is not responsible, such as natural wear and tear, force majeure, improper handling, intervention by the customer or third parties, excessive use, unsuitable equipment or extreme environmental influences.
§ 7) Right of Return
Products that show quality defects shall be returned to CYS within 7 days in unused, perfect condition and in the original packaging at customers own expense after prior consultation.
It is not possible to take back hygienic products or medical test kits, as they may become unusable if stored incorrectly or handled improperly.
§ 8) Retention of Ownership
The goods remain the property of CYS until full payment.
§ 9) Legal Notice
This is a translated version of the Standard Terms & Conditions. Should there be any discrepancies, the German version (Link: AGB) prevails.
The place of jurisdiction is 8006 Zurich. Swiss law shall apply exclusively.
